When someone is accused of a criminal act , there are several avenues to take. One such avenue is to take a polygraph examination to try to prove that they didn't commit the illegal act. This may be to prove to the courts or just family members and friends. Some of the most often asked questions are:

 

1. Are polygraphs admitted into criminal court as evidence in Utah?

 

The answer to this is a resounding yes and no. In Utah polygraph results can be admitted into evidence if both the prosecution and defense agree to let the results in. This doesn't happen very often, but we have had some of our examinations entered into evidence. But even when they are not entered in as evidence, they are commonly looked at by the prosecutor, police and judge and do have some weight to determine whether charges are filed.

 

2. What questions can I ask.

 

You will work with your examiner to determine the questions best suited for your examination. Some questions work well, some not as well and some have to be phrased a special way. The polygraph format does not work well with mixed issues and you will need to narrow your focus to one specific issue/ incident.

 

3. What can I find out with a polygraph?

 

The polygraph does not work well as a "fishing expedition", it's best to stick to one specific issue or incident. Additional polygraphs can be given for other incidents.
